A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was held in federal custody.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
